Party Sites"). HomeMeeting

Site and is not responsible for the contents of or any products

The Site may include meeting rooms and chat rooms (the "Services")
that allow real-time video/audio/text interaction between
users. You agree that you are solely responsible for the content
of all video, test, graphics, or audible communications sent
by you. You further agree not to use the Services to communicate
any message or material that is unlawful, threatening, abusive,
libelous, defamatory, obscene, vulgar, pornographic, profane
or indecent information of any kind, including without limitation
any transmission constituting or encouraging conduct that
would constitute a criminal offense, give rise to civil liability
or otherwise violate any local, state, national or foreign
law. HomeMeeting does not control
the messages, information or files delivered by the Services,
unless otherwise noted therein, and HomeMeeting
has no obligation to monitor such Services. However, HomeMeeting
reserves the right at all times to disclose any information
as necessary to satisfy any law, regulation or governmental
request, or terminate any such Services at any time without
notice to you that in HomeMeeting's
sole discretion are objectionable or in violation of the Agreement.
Your use the Site is at your risk. If you are dissatisfied
with any of the materials contained in the Site or by the
Services, or with any of these Terms and Conditions, your
sole and exclusive remedy is to discontinue accessing and
using the Site.
To the fullest extent permissible pursuant to applicable
law, neither Homemeeting nor
its affiliates is liable for any direct, incidental, consequential,
indirect, or punitive damages arising out of your access to,
or use of, the site. Without limiting the foregoing, everything
on the site is provided to you "as is" without warranty
of any kind, either expressed or implied, including, but not
limited to, the implied warranties or merchantability, fitness
for a particular purpose, or non-infringement. Homemeeting
and its affiliates make no warranty or representation regarding
the results that may be obtained from the use of the services,
regarding the accuracy or reliability of any information obtained
through the services, regarding any goods or services purchased
or obtained through the services, regarding any transactions
entered into through the services or that the services will
meet any user's requirements, or be uninterrupted, timely,
secure or error free.
The Site is controlled and operated by HomeMeeting
from its offices within the State of Washington, United States
of America. HomeMeeting makes
no representation that Materials or Services in the Site are
appropriate or available for use in other locations. Those
who choose to access this site from other locations do so
on their own initiative and are responsible for compliance
with local laws, if and to the extent local laws are applicable.
This agreement shall be governed by, construed and enforced
in accordance with the laws of the State of Washington, as
it is applied to agreements entered into and to be performed
entirely within such State. Any action you, any third party
or HomeMeeting bring to enforce
these Terms and Conditions or, in connection with, any matters
related to this site shall be brought only in either the state
or Federal Courts located in King County, Washington, and
you expressly consent to the jurisdiction of said courts.
This Agreement will terminate immediately without notice
from HomeMeeting if in HomeMeeting's
sole discretion you fail to comply with any term or provision
of this Agreement. Upon termination, you must destroy all
materials obtained from this Site and all copies thereof,
whether made under the terms of this Agreement or otherwise.
In the event of termination, you are no longer authorized
to access the Bulletin Boards and the restrictions imposed
on you with respect to Materials downloaded from the Bulletin
Boards and the disclaimers and limitations of liabilities
set forth in this Agreement shall survive.
If any provision of this Agreement shall be illegal, invalid,
void, or for any reason unenforceable then that provision
shall not be deemed a waiver from this agreement and shall
not affect the validity and enforceability of any remaining
provisions.
HomeMeeting may at any time
revise these Terms and Conditions by posting modified terms
on its website. You are bound by any such revisions and should
therefore periodically visit this page to review the then
current Terms and Conditions to which you are bound. This
Agreement has been prepared in the English Language and such
version shall be controlling in all respects and any non-English
version of this Agreement is solely for accommodation purposes. |
